1. General

(a) Senix Australia Pty Ltd ACN 678 127 298 (Senix Tools) of 3/32 Westside Avenue, Port Melbourne VIC 3207, info@senixtool.com and 1300 461 825, provides a warranty to Customers in respect of each Eligible Product on the terms set out in these Warranty Terms.

(b) In these Warranty Terms, 'us', 'we' and 'our' means Senix Tools and each of our 'group entities' (meaning any related body corporate or associated entity of Senix Tools or within its group of companies).

(c) We reserve the right to change any part of these Warranty Terms by posting updated Warranty Terms to our website (https://senix.com.au/. Each time you make a purchase from Senix Tools, your purchase is subject to the then current Warranty Terms. It is your responsibility to check this page periodically for changes and updates. Upon purchase, you are taken to have read and consented to the then current Warranty Terms.

(d) Senix Tools provides the following warranty in relation to any Senix Tools product (and any accessory supplied with it) that has been purchased from us, our authorised Senix Tools retailers and authorised third-party platforms (Eligible Product), including Amazon. Please go to our "find a dealer" webpage at www.senix.com.au/retailer/.

(e) This warranty applies when a Eligible Product is determined by Senix Tools to have a defect or fault in its material, manufacture or workmanship, not where any of the warranty exclusions apply (see clause 5 below). Where this warranty applies, to the extent required it covers the replacement of affected parts, the repair labour, potentially a refund of the price of the Eligible Product  and/or other compensation, as determined by Senix Tools in its sole discretion (acting reasonably).

(f) This warranty is provided to the original purchaser of an Eligible Product only and after a valid proof of purchase (identifying the date, price, and product(s) purchased) has been provided (Customer).


2. Warranty period

The warranty period for each product is as set out in the product warranty table below, and for each product will commence from the date of original purchase of the product.


3. Consumer protections

(a) Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.

(b) The benefits provided to the Customer in this warranty are in addition to the other rights and remedies of a consumer under the Australian Consumer Law (including "consumer guarantees" under the ACL) and any other laws in relation to the products to which this warranty relates.

(c) Where it applies, this warranty is in addition to any consumer guarantees that the Customer is entitled to under the Australian Consumer Law.


4. Hazardous materials

(a) Customers are responsible for the proper keeping, care and cleaning of their product prior to sending it to us for repair or replacement. It is an occupational health and safety risk for our staff to inspect, repair or service a product that has come into contact with a hazardous substance.

(b) Any product provided to us must be cleaned before being sent. If we are asked to inspect, repair or service a product that, in our opinion, has come into contact with a hazardous substance (including asbestos or silica dust), we may not be able to inspect, service or repair that product. Where this occurs, we will inform you and the product will be returned to you.

We reserve the right to refuse to inspect, repair or service a product which, in our opinion, has been exposed to a hazardous substance.


5. Warranty exclusions

5.1 This warranty does not apply where:

(a) the fault, failure or damage to the product is caused or directly contributed to by any repairs to the product which are made or attempted by the Customer (i.e., self-repair) or a service provider other than a Senix Tools authorised repair agent;

(b) in the opinion of Senix Tools, the alleged fault, failure or damage constitutes normal wear and tear. Specific parts of certain products (including gears, seals, O-rings, rotor commutator diameter wear exceeding 0.2mm, carbon brushes, bearings, switches, power cables, and spark plugs) must be regularly inspected so that wear and tear does not lead to failure of the product. Further, consumables are not subject to this warranty;

(c) the product has not been used, stored or maintained in accordance with the manufacturer's instructions and/or the operating instructions (if any) as provided with the product;

(d) the Customer uses or stores the product in an abnormal, careless or abusive manner (including dropping or crushing the product, exposing the product to extreme heat, exceeding the range of tool usage, overloading the product, or lack of adequate maintenance and care);

(e) the fault or damage has been caused by a user error, accidental damage, lack of proper keeping, care or cleaning of the product, improper maintenance, or any abuse, misuse or non-compliant use (including use that the relevant Product is not designed for);

(f) damage to the product is caused by sand, water damage, rust corrosion, fire, vermin and/or insect infestation, power outages or surges, or inadequate or improper voltage or current;

(g) in the opinion of Senix Tools, the product is or has been tampered with in any way;

(h) any defects caused by the use of non-original parts and/or accessories (unless used by Senix Tools or one of our authorised repair agents to repair a product under a warranty claim);

(i) any fault, defect or malfunction caused by modification(s) or addition(s) of parts to a product;

(j) the fault, failure or damage to the product is or has been caused by an extraordinary event or circumstance beyond the reasonable control of the Customer or Senix Tools; or

(k) the product's serial number has been altered or removed from the product.


5.2 Unless otherwise agreed in writing with us, to the full extent permitted at law, Senix Tools has no liability for, and is not required to provide warranty repairs or services under these Warranty Terms if it relates to:

(i) warranty services outside of business hours;

(ii) misusing or abusing a product or any of the accessories included;

(iii) using incorrect batteries, charges, accessories, or any unauthorised, non-genuine or non-standard parts;

(iv) tampering with a product in any way otherwise stated in any Senix Tools instructions, guides or manuals;

(v) making mechanical adjustments inconsistent with any Senix Tools instructions, guides or manuals;

(vi) not having taken reasonable steps to prevent damage or failure from occurring to the product;

(vii) storing the product inconsistently to the instructions provided any Senix Tools instructions, guides or manuals;

(viii) neglecting or otherwise failing to maintain the product in accordance with the instructions in any Senix Tools instructions, guides or manuals;

(ix) repairing or carrying out work on the product by any person other than Senix or an approved Senix Tools authorised repair agent;

(x) accidental damage or damage caused by Force Majeure Events which are beyond the reasonable control of Senix Tools or because of any act of God, war, insurrection, embargo, labour strike or industrial action, general component shortage, storm, flood, fire, lockdown, piracy, trade war, government sanction or prohibition, whether such cause existed or was foreseeable by Senix Tools or not;

(xi) natural discoloration of material due to ultraviolet-light;

(xii) natural impact with hard surfaces or damage caused in the transit of the product or to any damage;

(xiii) damage caused by excessive heat or cold;

(xiv) damage caused by dust, solvents, or water entry into the product;

(xv) damage caused by contact with sand, rust, corrosion, fire, vermin and insect infestation, power outages or surges or inadequate voltage or current;

(xvi) abnormal product performance caused by any ancillary equipment interference or other external factors;

(xvii) damage, failure or defects that occur for reason or reasons that were already disclosed to you or ought reasonably to have been disclosed to you prior to your purchase of the product;

(xviii) normal wear and tear;

(xix) calibration;

(xx) freight cost associated with transporting the product between you and Senix Tools;

(xxi) products with serial numbers that have been altered or removed; 

(xxii) consumable items supplied with the product or that are part of the product, such as battery packs.

(b)To the maximum extent permitted by law, all warranties, conditions and other terms express or implied by statute, custom or common law are excluded. However, as provided in clause 3 above, nothing in these Warranty Terms excludes or restricts any warranty, consumer guarantee or similar protection afforded to a consumer under the Australian Consumer Law which cannot be excluded or restricted.


6. Warranty claims

(a) To make a warranty claim, a Customer must present the following items to Senix Tools (warranty@senixtools.com.au or 1300 461 825) or an authorised repair agent within 90 days of the defect or malfunction first occurring:

(i) valid proof of purchase of the affected Eligible Product (e.g., original receipt or original paid invoice);

(ii) valid warranty card for the affected Eligible Product verified by the authorised repair agent (see template at clause 10 below); and

(iii) the affected Eligible Product  itself (that has not been subject to repair efforts, and has the defect or malfunction requiring repair).

(b) The product must not have been misused, adjusted, modified, or serviced by any person other than Senix Tools or an approved Senix Tools authorised repair agent.

(c) If the Customer cannot provide the above items, the Customer will not have warranty rights under these Warranty Terms.

(d) Senix Tools or our authorised repair agent will review your warranty claim to determine whether it is included, and not excluded by, these Warranty Terms. This judgement will be at Senix Tool's sole discretion at all times (acting reasonably).

(e)  Senix Tools or one of our authorised repair agents may request further information from you in relation to reviewing or processing your warranty claim, such as your personal contact details (including your phone number, postal or residential address, and email address) and information about use of the product. To enjoy the benefit of this warranty, your reasonable co-operation in giving this information is required. Senix Tools will confirm by email or by telephone whether the warranty claim is covered under these terms and next steps.

(f) Senix Tools will honour all warranty claims that are submitted by a Customer in accordance with these Warranty Terms, subject to its approval under this clause.


7. Repairs

(a) A product subject to a warranty claim made by a Customer and accepted by Senix Tools under these Warranty Terms must be provided to Senix Tools for inspection and repair.

(b) A product presented for repair may be replaced by refurbished products of the same type and same age or level of wear and tear, rather than being repaired or replaced by new. Refurbished parts of the same type and same age or level of wear and tear may be used to repair the Eligible Product.

(c) The product covered under these Warranty Terms will be repaired during normal business hours at the premises of Senix Tools or one of our authorised repair agents without cost to the Customer for parts and repair labour.

(d)  The Customer is responsible for freight costs and insurance costs if the product must be returned for repair or inspection to Senix Tools or one of our authorised repair agents. If the associate cost is significant and we are liable for the replacement or repair, freight and associated insurance will be at our cost (at our choice of provider).


8. Refunds

(a) You may be entitled to a refund if the product, in accordance with the Australian Consumer Law:

(i) is faulty or not of acceptable quality;

(ii) not fit for its intended purpose; or

(iii) does not match its sample or description,

and we have not provided, or we will not provide, a replacement.

(b) Any amounts refunded to you under these Warranty Terms (if any) will be processed using the payment method on your original receipt or original tax invoice.
